Workers’ Compensation Attorney Thomas W. Herman of The Law Firm of Westmoreland, Patterson, Moseley, and Hinson in Macon, GA, answers the question:
I’m frequently asked whether someone injured on the job can also claim unemployment. The answer depends on whether or not you are completely restricted from work or are able to work in some capacity. Under Georgia law, to claim unemployment, you have to prove you are ready, willing, and able to work.
So, if the doctor has you on no work status, you’re not eligible for unemployment. However, if you’re on restricted duty status and receiving workers’ compensation, you cannot also claim unemployment benefits at the same time, as Georgia law prohibits receiving both simultaneously.
